MITX Member Survey Sweepstakes

The MITX Survey Sweepstakes is sponsored by The Massachusetts Innovation & Technology Exchange (MITX), 222 Third Street, Suite 0300, Cambridge, MA 02090.

OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN. THE SWEEPSTAKES IS OPEN ONLY TO LEGAL RESIDENTS OF THE UNITED STATES AGED 18 OR OLDER WHO HAVE HAD ACCESS TO THE INTERNET AND AN EMAIL ADDRESS PRIOR TO RECEIVING NOTIFICATION OF THE SWEEPSTAKES.

Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules.

1. Eligibility: Sweepstakes is open to all natural persons age 18 or older who are members of MITX and are legal residents of the United States or the District of Columbia who have had access to the Internet and an email address prior to receiving notification of the Sweepstakes. Employees, officers, and directors of Sponsor, its advertising, promotion, and fulfillment agencies, their immediate family members and persons living in their same household are not eligible to participate in Sweepstakes. Void where prohibited by law.

2. How to Enter:  You may enter the Sweepstakes in one of two ways:

(i) Online: Access the MITX Survey with an email invitation by emailing info@mitx.org.

(ii) By Mail: Legibly hand-print on a 4" x 6" card the words "MITX SURVEY SWEEPSTAKES," along with your name, address, e-mail address and telephone number and mail the entry to: MITX Survey Sweepstakes, The Massachusetts Innovation & Technology Exchange, 222 Third Street, Suite 0300, Cambridge, MA 02090.

Online entries must be received by 11:59 a.m. EST December 5, 2008, and mail-in entries must be postmarked by December 5, 2008 and received by December 12, 2008.  Only one entry per household or e-mail address is permitted. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.

3. Prizes: Sponsor will give away eight (8) $25 American Express gift card to selected winners.  No alternative prize or substitution is permitted except by Sponsor, who may substitute prizes of equal or greater value. Prize is nontransferable. All federal, state, provincial and/or local taxes are the sole responsibility of the winner.  Winner may be required to complete certain tax-related forms.

4. Selection of Winner: Winners will be determined by random drawing from all eligible entries received, to be held on or about December 10, 2008 at the offices of Sponsor or its third-party service provider.  All decisions are final and binding. Odds of winning will be determined by the number of eligible entries received.

5. Prize Redemption:  Sponsor will notify all participants via email on or about December 17, 2008. Winner will be sent additional details of prize and acceptance requirements by mail or courier.  Winner may be required to sign and return a release of liability, declaration of eligibility, and where lawful, a publicity consent agreement, all within 10 days of notification.  If a selected winner cannot be contacted, is ineligible, fails to claim a prize before January 7, 2009, or fails to timely return the completed and executed declaration, release and consent as may be required, prize may be forfeited and an alternate winner selected. In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the authorized account holder of the e-mail account.

6. Limitation of Liability:  Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winner. By accepting and/or using prize, winner agrees to the use of his/her name, voice, and/or likeness for the purpose of advertising, trade, or promotion without further compensation, unless prohibited by law.

7. General Terms and Conditions:  By entering, each participant agrees to be bound by these Official Rules and the decisions of Sponsor, which shall be final. Sponsor, agents and representatives of Sponsor, its parent company, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible entries; (ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, or difficulties of any kind; (iii) failed, incomplete, garbled, or delayed computer transmissions; (iv) any condition caused by events beyond the control of the Sponsor that may cause the Sweepstakes to be disrupted or corrupted; (v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Sweepstakes; or (vi) any printing or typographical errors in any materials associated with the Sweepstakes. Sponsor reserves the right, in its sole discretion, to suspend or cancel Sweepstakes at any time if a computer virus, bug, or other technical problem affects the administration, security, or proper play of the Sweepstakes.  By participating in the Sweepstakes, participant agrees to release and hold Sponsor and the employees, officers, directors, shareholders, agents, representatives of Sponsor, its parent company, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Sweepstakes or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, property damage, and claims based on publicity rights, defamation, or invasion of privacy.
